Notes for Elisha Stillwell

Probate Court records of Arkansas County show that he served
on jury duty in 1828 and 1829. On May 29m 1829 he secured bond for John
Cook as Administrator of the estate of his father and on October 4, 1830
for Harold Stillwell as Administrator of the estate of his brother, John
Stillwell. On January 5, 1831, he was among the purchasers of the estate
of Daniel Whitney. His wife's name was Elizabeth but her maiden name is
not known. They did not have any choldern but they raised his nephew,
Elisha, son of John Stillwell, who was legally bound to him July 11, 1838
as stated above. Elisha died on August 16, 1846. His widow, Elizabeth
was later married to William riley Hagler. She was buried in the
cemetery on the Stillwell homestead.

Following is a copy of the will of Elisha Stillwell which is
among the miscellaneous probate papers in the custody of the County clerk
at DeWitt.

"In the name of god Amen, I elisha Stillwell, of the State of
Arkansas and County of Arkansas, do this twenty-fourth day of August in
the year of Christ One Thousand Eight hundred and forty-three make my
last Will and Testament as follows, To Wit, to my beloved wife Elizabeth
Stillwell I give and bequeath my whole and entire Estate both Real,
personal and mixed for and during her natural life to use and enjoy the
same according to her good pleasure- After the death of my wife Elizabeth
aforesaid - I desire and do give and bequeath unto my Nephew elisha
Stillwell, son of the late John Stillwell, deceased, for the love and
good will I bear said Elisha the entire remainder of my Estate of what
kind soever- After the death of my belived wife aforesaid to have and to
hold the same in fee simple forever. And it is also my desire that
Benjamin L. Haller of the State and County aforesaid be my Executor to
carry into effect this my last Will and Testament.

In Witness wherof I have this 24th day of August in the year of
Christ Eighteen hundred and forty-three set my hand and affixed my seal
in presence of Harold Stillwell & Asher H. Stillwell who I request to
witness same.

On October 17, 1848 B. L. Haller posted a five thousand
dollar bond with Harold Stillwell and Lewis L. Refeld as securities as
"Executor of the last will and testament of Elisha Stillwell deceased.
The bond was approved at the April 1849 Term of the Arkansas County
Probate Court.
